("TMNA"), a subsidiary of Toyota Motor Corporation ("TMC") (collectively, "Toyota"), to manage its Service Information Licensing Program and monitor unauthorized use of their Service Information. We write today regarding the unauthorized use of intellectual property by your organization on online platforms under your control. As the world’s largest automobile company and global leader in automotive manufacturing, Toyota owns a robust intellectual property portfolio, which includes vehicle repair manuals developed through significant time and financial investment. These manuals are protected by Toyota under U.S. copyright law. Notably, Toyota already provides access to its copyrighted materials exclusively through its Technical Information System ("TIS") and has not authorized your organization to use them. Any unauthorized copying, distribution, or commercial exploitation constitutes copyright infringement. Accordingly, Toyota must take appropriate steps to protect its intellectual property and prevent consumer confusion and harm to its business interests. While Toyota prefers to resolve matters amicably, it takes violations of its intellectual property rights seriously. As such, Toyota must demand that you immediately cease and permanently desist from the unauthorized reproduction, distribution, or sale of any Toyota service manuals on any website or platform under your control. Please provide written confirmation within seven (7) business days of the date of this letter describing the steps taken to comply and confirming that no further unauthorized use will occur.
